Services Provided
Vybe Creative Films offers: Film and video production services; Lead generation for independent videographers and studios; A digital platform where videographers may be listed, promoted, and contacted by potential clients. Vybe reserves the right to modify or discontinue any part of the Services at any time without notice.
Parts of this website offer an opportunity for users to post and exchange opinions and information in certain areas of the website. Vybe Creative Fims does not filter, edit, publish or review Comments prior to their presence on the website. Comments do not reflect the views and opinions of Vybe Creative Fims or its agents. Comments reflect the views and opinions of the person who post their views and opinions. To the extent permitted by applicable laws, Vybe Creative Fims shall not be liable for the Comments or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website.
Vybe Creative Fims reserves the right to monitor all Comments and to remove any Comments which can be considered inappropriate, offensive or causes breach of these Terms and Conditions.

Lead Distribution and Listings
Videographers may receive leads through our platform. Vybe does not guarantee any specific number of leads, jobs, or bookings. Leads are generated based on interest, availability, geography, and other internal metrics. Vybe may verify or screen videographers, but does not endorse or guarantee the quality of their services.
Payments and Subscriptions
Certain Services may be subject to fees, including premium listings or lead access. All fees are non-refundable unless otherwise stated in a separate agreement. Vybe may change its pricing at any time with notice.
Intellectual Property
All content on the platform, including text, images, logos, and videos created by Vybe, are the intellectual property of Vybe Creative Films and may not be copied or reused without permission. Users retain rights to content they create, but grant Vybe a non-exclusive license to display it for promotional or service-related purposes.
Indemnification
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless https://vybecreativefilms.com/and our officers, directors, agents, partners, and employees (collectively, the “Vybe Creative Films Parties”) from any claims, damages, losses, or expenses arising from your violation of these Terms or any rights of others (including intellectual property rights or privacy rights), or from your illegal activities. You agree to promptly notify the Vybe Creative Films Parties of any third-party claims, cooperate in defending those claims, and pay all related fees and costs, including legal fees. Vybe Creative Films Parties have control over the defense or settlement of such claims.
Resolving Disputes; Binding Arbitration
We prefer to resolve disputes informally. Before filing a claim against https://vybecreativefilms.com, please contact us by sending a written notice to contact@vybecreativefilms.com or by certified mail to:

The notice must include:
- Your name, address, email address, and phone number
- A description of the issue
- The specific relief sought
If the dispute is not resolved within 30 days, either party may initiate formal proceedings.
Please read this section carefully, as it requires arbitration for certain disputes and limits how you can seek relief. You can opt out of arbitration by following the instructions below.
(a) No Representative Actions: You and https://vybecreativefilms.com/agree that disputes are personal and must be resolved individually. Class actions, class arbitrations, or any representative proceedings are not permitted.
(b) Arbitration of Disputes: Except for small claims or disputes seeking injunctive relief for intellectual property issues, you and https://vybecreativefilms.com/agree to resolve all disputes (including privacy or data security issues) through binding arbitration instead of court. Arbitration will be held in Grand Rapids, Michigan, unless you are a consumer, in which case you may choose the county of your residence.
(c) Federal Arbitration Act: The Federal Arbitration Act governs this section, and the arbitrator has authority to make procedural and substantive decisions. The arbitrator can only conduct individual arbitrations, not class actions.
(d) Discovery and Confidentiality: The arbitration will allow for discovery of non-privileged information. All proceedings and decisions are confidential unless disclosure is required by law or court order.
(e) Jurisdiction: Any appeal or enforcement of arbitration must be filed in state or federal courts in Grand Rapids, Michigan.
(f) Time Limit for Filing: Disputes must be filed within one year of when the claim arose, or the claim is permanently barred.
(g) Opt-Out: You have 30 days from accepting these Terms to opt out of arbitration by sending an email to contact@vybecreativefilms.com with your full name and address. Opting out means disputes will be resolved in court, not arbitration.
(h) Severability: If any part of this section is unenforceable, it will not affect the remaining provisions. If class action claims must proceed in court, they will be stayed pending the outcome of individual arbitration.
Prohibited Conduct
You agree not to: Misrepresent your identity or qualifications; Use leads or platform access to solicit business outside of permitted channels; Post defamatory, abusive, or illegal content; Interfere with system integrity or security.
Disclaimers and Limitation of Liability
Vybe provides the Services “as is” and makes no warranties regarding lead quality, job outcomes, or user behavior. Vybe is not liable for any direct or indirect damages resulting from your use of the Services.
Termination
We may suspend or terminate your access to the Services at our sole discretion if you violate these Terms.
Governing Law
These Terms are governed by Michigan law, excluding its conflict of law principles. Any disputes not subject to arbitration or small claims court will be resolved in the courts of Michigan, specifically in Kent County, Michigan.
